Austrian Real Estate Dictionary: 150+ Terms You Need to Understand Before Buying

October 10, 2026

In a Vienna apartment listing, you might see terms like "Nutzfläche," "Rücklage," "Wohnungseigentum," or "Baurecht." A contract will also include "Kaufanbot," "Treuhandkonto," and "Aufsandungserklärung." Translation helps clarify the words, but doesn't always explain the rights, expenses, and obligations they entail.

For example, Kaufanbot can engage a buyer even before a detailed contract is signed. A "Rücklage" (a "Rücklage") doesn't mean the house will have enough money for future renovations. And Neubau (a "new building") in an ad doesn't necessarily indicate a newly constructed building.

This Vienna Property dictionary explains terms used when choosing, buying, and owning real estate in Austria. Each term is defined and includes information on what buyers should pay attention to. Definitions help prepare for discussions about a specific property with an agent, lawyer, notary, or tax advisor.

How to use a dictionary

The terms are grouped according to the buyer's tasks:

1. Transaction and registration of ownership.
2. Forms of ownership and investment objects.
3. Lease and leasehold rights.
4. Building, layout and area.
5. Taxes, fees and expenses.
6. Documents for the apartment and house.
7. Parties to the transaction and government agencies.

At the end, we've compiled a list of common translation errors, answers to questions, and a short list of documents to check. Terminology is explained; detailed calculations and procedures are located in the blog's dedicated sections.

"Unraveling terminology isn't linguistics, but part of the legal due diligence process. When a client understands what's written on Sheet C of the extract and in the minutes of the owners' meeting, they make their own decisions, rather than relying on someone else's interpretation. My job is to help them reach this point before signing, not after.".

1. Transaction and registration of property rights

When purchasing real estate in Austria, signing the contract and registering the title are separate stages. Title is established with the entry in the deed book. The handover of keys and payment may occur on other dates specified in the contract.

Term Meaning and what a buyer should check
Kaufanbot An offer to purchase under specific conditions. It typically binds the buyer for a specified period. If the seller accepts a sufficiently specific offer in a timely manner, a legally binding contract may be created. This is not simply a viewing request or a reservation.
Bindungsfrist The period during which an offer to purchase remains binding on its proposer. Before signing, it's important to verify the expiration date and agreed-upon termination terms.
Anbotsannahme Acceptance of the offer by the seller. The legal consequences depend on the content of the offer, the timeliness of acceptance, and the terms and conditions specified.
Kaufvertrag A purchase and sale agreement. It establishes the property, price, payments, transfer, warranties, and other terms. Registration of title requires documents in the prescribed form, including proper certification of signatures.
Aufsandungserklärung Express consent to make a specific entry in the Grundbuch. In a purchase transaction, this usually refers to the seller's consent to register the buyer's title. It may be contained in the contract or a separate document.
Treuhand / Treuhandschaft Trusted transaction support: an authorized representative manages funds and documents within the agreed-upon terms. The scope of the trust and the payment procedure to the seller are important.
Treuhandkonto / Anderkonto A trust account for the safekeeping and transfer of funds. The account name itself doesn't explain the terms of protection; you need to review the trust agreement and the grounds for payment.
Grundbuch The land register is a state registry of real estate rights. It records owners, registered rights, and encumbrances. The extract is read in conjunction with the related documents.
Einverleibung The final registration of a right in the Grundbuch, such as a title or mortgage. In a standard sale and purchase, it is the registration that makes the buyer the owner.
Einlagezahl (EZ) The number of a real estate property registration within a cadastral community. It is used for identification in conjunction with the Katastralgemeinde designation.
Katastralgemeinde (KG) A cadastral community is a territorial registration unit. Its name and number help correctly identify a property in the registry.
Grundstücksnummer Land parcel number in the cadastral community. One Grundbuch entry may include multiple parcels.
Anmerkung der Rangordnung A mark that ensures priority for future registration of a sale or mortgage. Typically, it is valid for one year from the date the application is approved. It does not prohibit the owner from making subsequent transactions.
Wormerkung Conditional registration of title, which requires subsequent confirmation (Rechtfertigung). It is not equivalent to final registration of ownership.
Lastenfreistellung Release of the property from agreed-upon encumbrances. Specifically, the removal of the seller's mortgage. The contract must specify which entries are removed, by whom, and at whose expense.
Pfandrecht A lien, usually securing a loan. The secured obligation, the amount of the registered lien, and the procedure for its removal or retention are examined.
Dienstbarkeit / Servitude Servitude: a right of passage, travel, use, or other limited right over another's property. The content and meaning of a specific right is determined by the document on which it is based.
Belastungs- und Veräußerungsverbot A prohibition on encumbrance and alienation. May require the consent of the person in whose favor it is established. Its validity depends on the legal basis and registration.
Vorkaufsrecht Right of first refusal. When selling, the holder of this right may be required to offer the property under appropriate terms. The sale procedure is verified before the transaction is completed.
Gewährleistung Legal liability for defects in the property. It's important to check the agreed-upon specifications and terms of the contract: the ability to limit liability depends, in particular, on the status of the parties.
Übergabe The actual transfer of the property. Typically, the keys, the condition of the premises, meter readings, and the transferred documents are recorded. The transfer itself does not replace the registration of ownership.
Grundverkehrsbehörde The authority that reviews real estate acquisitions in accordance with the regulations of the relevant federal state. Permission may be required based on the buyer's status or the characteristics of the property.
Self-sufficiency Calculation and transfer of the required payments by an authorized representative, usually a lawyer or notary. The buyer should receive the calculation and confirmation of the completed actions.

What's important to understand before Kaufanbot

Before signing the offer, it is necessary to agree on the purchase price, term, and necessary conditions, including applicable restrictions on foreigners purchasing real estate in Austria. If the transaction is contingent on bank financing or an acquisition permit, this must be clearly reflected in the documents. A verbal explanation does not replace a contractual agreement.

Settlement and registration mechanisms work together. The Rangordnung (registration) protects the priority of registration, the Treuhand (treasury) regulates the handling of money, and the Lastenfreistellung (last freehold) determines the release of encumbrances. Their application and sequence are determined for a specific transaction.

2. Forms of ownership and investment objects

A tenancy agreement allows the exclusive use and disposal of a specific apartment. At the same time, the owner holds a share in the shared property. Therefore, when purchasing, both the documents for the apartment and the entire building are important.

Term Meaning and what a buyer should check
Eigentum Ownership rights. The scope of an owner's rights depends on the law, registered encumbrances, and other applicable restrictions.
Miteigentum Shared ownership of real estate. A single share without a formal title deed does not constitute exclusive ownership of a specific apartment.
Wohnungseigentum (WE) The right to exclusively use and dispose of a specific apartment, separate room or parking space, associated with a share in a common property.
Eigentümergemeinschaft A community of property owners that acts in matters of shared property management. Building maintenance decisions can impact the apartment owner's expenses.
Mindestanteil The share in the joint property required for the corresponding right of Wohnungseigentum. Its size is compared with the documents for the acquired property.
Nutzwert The estimated relative value of an individual property. Used to determine shares; takes into account area and adjustments for property characteristics. It is not a market price.
Parifizierung A term used in practice to determine the Nutzwert of individual properties. The calculation itself does not complete the registration of apartment ownership; the relevant documents and registration are required.
Allgemeinteile Common areas of the property: for example, stairs, façade, roof, or utility systems. The composition and usage procedures are specified in the building's documentation.
Zubehör-Wohnungseigentum Appurtenances legally associated with a specific apartment property, such as a specific basement or garden plot. A parking space may be a separate property; its status is verified independently.
Baurecht A property right to own a building on someone else's land. It is established for a term of 10 to 100 years. The remaining term, the contract, payments, and the consequences of termination are important.
Superädifikat A structure erected on someone else's land without the intention of permanent residence. This is a special legal structure distinct from a baurecht.
Fruchtgenussrecht The right to use someone else's property and receive income from it. This may limit the owner's ability to independently use or rent the property.
Wohnrecht The right to reside or use housing within a specified scope. The persons, premises, and duration are determined by the basis of this right.
Genossenschaftswohnung A colloquial term for housing owned by a non-profit housing organization, often a cooperative. Typically, it involves renting or using the property with a financial contribution. A subsequent purchase is possible if the conditions are met; this is not guaranteed for every apartment.
Gemeindewohnung / Gemeindebau Municipal apartment/municipal residential building. This type of housing is provided under special rules and is not included in the regular private apartment market.
Vorsorgewohnung An apartment purchased for long-term rental income generation. The title does not guarantee income, VAT deduction, or other tax advantages.
Anlegerwohnung Investment apartment. A general market designation for an investor property, without its own specific legal status.
Bauherrenmodell An investment model for participating in the construction or renovation of real estate. Rights, obligations, risks, and tax implications depend on the specific project structure.
Zinshaus A tenement building designed to generate rental income. The term is often applied to older apartment buildings, but age alone does not determine the legal status.
Immobilien-GmbH A limited liability company that owns real estate or carries out related transactions. Purchasing through a limited liability company does not automatically waive permit requirements.
Share Deal Acquiring shares or stock in a company that owns real estate. The buyer gains ownership in the company rather than purchasing the property directly. Review of corporate liabilities and tax implications is required.

Why equity in a home matters

Two apartments of the same size may have different Nutzwert and different shares in the shared property. When assessing current payments, it's important to check not only the share but also the current procedure for distributing expenses: the law, owners' agreements, and special regulations may provide for different calculation bases.

For Baurecht, the end date and conditions are examined separately. For Share Deals, the company's obligations, participation structure, and taxation are considered. These structures cannot be compared to a standard apartment purchase based solely on the asking price.

When investing in Austrian real estate, the form of ownership affects the costs, management procedures and the possibilities of its use.

3. Lease and lease law

The applicable rental regime is important for an apartment planned for rent. It determines the permissible rent, tenant protection, and contract requirements. The word "Altbau" or Neubau alone in an ad cannot determine this regime.

Term Meaning and what a buyer should check
MRG — Mietrechtsgesetz The Lease Law may apply in full, in part, or not to a specific contract. Other applicable rules, including general civil law rules, remain in effect.
Vollanwendung Full application of the MRG. This includes, among other things, rules on acceptable rent, operating costs, and protection against lease termination. The specific method for determining rent depends on the property and the agreement.
Teilanwendung Partial application of the MRG. Certain protective provisions remain in place, although the base rent restrictions under the MRG generally do not apply. This is not a lack of regulation.
Vollausnahme Exclusion of the contract from the scope of the MRG. Rights and obligations are determined by other applicable rules and conditions of the contract. The basis for exclusion must be confirmed.
Hauptmietzins Basic rent. This is separate from additional charges, such as operating expenses, fees for individual services, and VAT, if applicable.
Richtwertmietzins Rent calculated based on the Richtwert with permitted surcharges and discounts. Applies in cases specified by law, but not to all older apartments.
Richtwert A base value established for the federal state for calculating certain regulated rents. It is not the average market rent.
Lagezuschlag A location surcharge is applied when calculating regulated rent. Its admissibility and justification are verified for the specific address and contract.
Category Rent is based on the apartment's equipment category. This is tied to certain contractual and transitional arrangements. It cannot be automatically applied to all apartments of the same category.
Angemessener Mietzins A reasonable rent in cases stipulated by the MRG. Determined based on the property's characteristics and location, not just the owner's preferences.
Befristung Setting the lease term. For residential contracts in the MRG sector, under the rules in effect since 2026, the minimum term is generally five years for landlords who are entrepreneurs, and three years for landlords who are not entrepreneurs under the KSchG. The contract date and transitional provisions are checked.
Befristungsabschlag A discount for a short-term lease when applicable rental restrictions apply. This discount is not mandatory for all leases in Austria.
Kündigungsverzicht An agreed-upon waiver of a standard termination for a specified period. It's important to check who it applies to and what grounds for termination remain.
Wertsicherungsklausel A provision for rent adjustment based on an index or other agreed-upon mechanism. Applies subject to applicable restrictions and contract requirements.
MieWeG - Mieten-Wertsicherungsgesetz The law governing the terms of rent indexation. The specific calculation depends on the scope of application, the contract date, and transitional provisions.
Caution Tenant's security deposit. This is used to cover reasonable claims and is refundable in full upon termination of the lease. This is not a purchase price for the apartment.
Ablöse A payment, for example, for transferred furniture or certain improvements. Whether it is permissible depends on the basis and proportionality of the consideration; an unreasonable fee for obtaining a contract may be unlawful.
Investitionsablöse Compensation for certain tenant investments upon lease termination. Eligibility depends on the type of improvements made and compliance with legal terms and conditions.
Untermiete Sublease. The possibility of subletting and the limits of restrictions depend on the agreement and applicable regulations. It does not always require separate consent in the same form.
Eintrittsrecht The right of certain persons to enter into an existing lease agreement under certain circumstances. Kinship alone does not guarantee such a right.
Erhaltungspflicht The responsibility for maintenance and repair of certain faults. The distribution of responsibility between the parties depends on the legal regime and the nature of the work.
Räumungsklage Eviction or vacate the premises. A forced vacate requires the legally established procedure; changing the locks yourself does not replace it.
Schlichtungsstelle A municipal authority for certain housing disputes. In Vienna, it hears cases defined by law; it is not a mandatory first step in any rental dispute.
Mietvertragsgebühr Lease Agreement Fee. Waived for residential lease agreements; applicability for other agreements is determined separately.

Why the year of construction doesn't give a complete answer

When determining the MRG , the date of the building permit, the existence of apartment ownership, state funding, the creation of new premises, and other circumstances are taken into account. For example, a later-developed attic in an old building may have a different regime than the apartments on its lower floors.

For an investor, the legal regime is first established, then the current contract is verified, and only then is the rental income calculated. The rate listed on the ad or in a neighboring apartment does not confirm the acceptable rate for the property being purchased.

The income forecast also needs to take into account the rent indexation conditions in Vienna: annual increases cannot be factored in automatically.

  • Case study:

The buyer planned to move into the apartment after the lease expired. I reviewed the contract and identified circumstances that required a legal assessment of the validity of this term. Together with a lawyer, we determined that it was impossible to expect the apartment to be vacated by the stated date. I reviewed the selection criteria: for a purchase for personal use, a property with a confirmed free transfer was required. This eliminated an option that didn't suit the buyer's plans.

4. Building, layout and area

The terms in the listing help you visualize the apartment, but they don't replace checking the floor plan, permits, and actual condition. This is especially important when comparing sizes and buying an apartment in Altbau in Vienna, where you need to check the documentation for any renovations and remodeling.

Term Meaning and what a buyer should check
Altbau An old building; on the Viennese market, this is often used to describe a historic building. There is no single date by which this term determines all legal consequences. Separate criteria are applied for leasing and construction.
Spring time A historical era of intensive urban development from the 19th to early 20th centuries. It designates an architectural period, not a confirmation of technical condition or conservation status.
Neubau A new or relatively new building in the market classification. May refer to a house built decades ago. Does not indicate recent completion.
Erstbezug First occupancy. This may refer to a new property or a first use after renovation. It's important to clarify what exactly was built or renovated.
Dachgeschossausbau (DG) Converting living spaces into attic or loft spaces. They check permits, the registered area, and the independent legal status of the resulting structure.
Rohdachboden An undeveloped attic. The ability to create housing depends on the property's title, approvals, building requirements, and technical specifications.
Souterrain A space below or partially below ground level. Residential use is determined by the permitted purpose and building regulations.
Hochparterre Raised ground floor. Window height, accessibility, and actual location require on-site verification.
Mezzanin An intermediate floor, typical of some historic buildings. Its position and height cannot be reliably determined by its name alone.
Stiege A staircase, entrance, or building section. The Stiege number may be part of the address and is needed to accurately identify the apartment.
Top Designation of a separate apartment or premises, for example Top 14. The number is verified between the advertisement, plan, contract, and ownership documents.
Cabinet A small room. The term itself does not indicate separate heating, compliance with residential requirements, or the ability to use it as a bedroom.
Loggia A space built into the building's volume and open on one side. If the established criteria are met, its area is included in the Nutzfläche (balcony area); a loggia is not automatically considered a balcony.
Bay window A bay window is a protruding part of a room. It's important to check the plan, actual dimensions, and the condition of the structure.
Innenhof Inner courtyard. Windows overlooking the courtyard don't guarantee quiet or good lighting: its size, use, and adjacent spaces are important factors.
Wohnnutzfläche Usable area of a residential property. The calculation procedure is clarified based on documents and the applicable basis; advertising area designations alone are insufficient.
Nutzfläche Usable area used in calculations required by law. Under MRG and WEG, open balconies and terraces are not included, but loggias may be. For basements and attics, suitability for residential or commercial use is important.
Category A, B, C, D Apartment equipment categories according to MRG. These take into account the legally established characteristics and the condition of the property at the legally relevant time. The category letter does not replace the equipment description.
Widmung The purpose of a territory or an individual property depends on the context. It's important to distinguish between the urban planning purpose of the site, the permitted use of the premises, and the purpose as specified in the apartment ownership documents.
Flächenwidmungsplan A zoning plan for the permitted use of the site and adjacent areas. It helps assess the permitted uses of the site and adjacent areas.
Bebauungsplan Development plan. Contains parameters for permitted construction, such as height, building lines, and other restrictions.
Zweitwohnsitz A second residence. Registering it does not grant permission to use the property as a tourist or vacation home. Restrictions and possible fees vary by region.
Denkmalschutz Monument protection. Requirements depend on the specific status and planned work. Monument protection approval and construction permits are different matters.
Schutzzone A protected development zone, particularly in Vienna, may restrict changes to the building's appearance and other works, but does not automatically grant it the status of a monument.
Thermische Sanierung Improving the building's thermal performance: for example, insulating or upgrading individual elements. The scope and results must be documented.
Generalsanierung A comprehensive renovation or major renovation. A market designation without a comprehensive list of works: please inquire about what was completed and when.
Sanierungsbedürftig Requiring repair or reconstruction. The wording does not indicate a budget: the estimate depends on the condition of the structure, engineering, permits, and the scope of work.

How to avoid mistakes when comparing areas

When comparing two apartments, it's important to understand how the area of each is calculated. A balcony, loggia, terrace, and usable basement may have different statuses. Adding together all the area values listed in the ad doesn't necessarily yield a legally valid area.

The City of Vienna's MA 25 explanations specifically address loggias, balconies, terraces, and other elements. For a specific apartment, it's helpful to compare the listing, floor plan, and documents that determine the area and share.

  • Case study:

The buyer was considering an apartment priced at €320,000 with a listed area of 80 m². I compared the listing with the floor plan and the area calculation: the listed figure included an 8 m² open balcony. The interior area was 72 m², so the price came out to about €4,444/m² instead of €4,000/m². I recalculated comparable offers, separately taking into account the value of the balcony. The buyer received a reasonable valuation of the property before submitting an offer.

5. Taxes, fees and expenses

It's important for the buyer to separate one-time transaction costs, ongoing owner payments, and taxes payable upon receipt of income or sale. These amounts arise for different reasons and should not be combined into a single "cost of maintenance" figure.

Term Meaning and what a buyer should check
Kaufnebenkosten Ancillary expenses associated with the purchase include taxes, registration fees, legal support, commissions, and other transaction-specific costs. These are calculated separately from the apartment's price.
Grunderwerbsteuer (GrESt) Real estate acquisition tax. For a typical purchase for consideration, the standard rate is 3.5%; the tax base and exceptions depend on the type of transfer.
Eintragungsgebühr Fee for entering a title into the Grundbuch. The standard property registration rate is 1.1% of the title's value; possible exemptions are verified by the current terms and conditions.
Pfandrechtseintragungsgebühr Registration fee for collateral. The fee is based on the collateral being registered and may differ from the actual loan amount.
Vertragserrichtungskosten Contract preparation and management costs. It's important to determine the scope of services, VAT, additional costs, and whether fiduciary support is included.
Maklerprovision Brokerage commission. For a typical apartment purchase over €48,448.51, the maximum rate for each party is 3% plus VAT. For smaller amounts, different limits apply; the actual liability is verified by the contract.
Bestellerprinzip The first-to-client principle applies to rental brokerage. This determines who may be required to pay a commission. This does not automatically apply to real estate purchases and sales.
Grundsteuer A periodic property tax. The amount is determined based on the relevant criteria and municipal regulations; it is not a purchase tax.
Betriebskosten Operating costs. Under the full application of the MRG, their list is regulated by law; in other regimes, additional legal and contractual factors are important. Not all of the owner's monthly payment is considered Betriebskosten.
Betriebskostenabrechnung Report and recalculate operating expenses for the period. Allows you to verify accruals and compare them with advance payments.
Rücklage A homeowners' association reserve for future expenses, particularly for building maintenance. The actual balance, planned expenses, and contribution amounts are verified. The presence of a reserve does not guarantee the absence of additional fees.
Instandhaltungskosten Costs of maintaining the property. It's important to distinguish between work performed inside the apartment and expenses for common areas of the building.
Hausverwaltungshonorar Management company remuneration. The procedure for calculating and assigning it to owners or tenants depends on the applicable regime.
Heizkostenabrechnung Calculate heating costs, and if the system is appropriate, also hot water costs. The period, distribution method, and actual consumption are verified.
Rauchfangkehrer A chimney sweep or a specialist who performs relevant inspections. This is the service provider, and the invoice will identify related services if they are required for the facility.
Zweitwohnsitzabgabe A second home fee, where established by applicable regional or municipal regulations. This is not a single federal tax; the presence of the fee is verified at the location of the property.
Umsatzsteuer (USt) VAT. For taxable residential rent, a 10% rate is generally applied, but exemptions and special rules may apply; parking and certain services may have a different rate.
Vorsteuerabzug Input VAT deduction subject to legal conditions being met. Purchasing an investment apartment does not in itself create an unconditional right to a deduction.
AfA - Absetzung für Abnutzung Tax depreciation. For buildings with rental income, the standard statutory depreciation rate is typically 1.5% per annum. Land is not depreciated; special tax regimes and the depreciation base require separate calculations.
Liebhaberei Tax classification of activities not aimed at generating comprehensive profit in the established sense. May affect loss recognition and VAT treatment. The presence of a negative result in a particular year is not sufficient to establish a conclusion.
ImmoESt - Immobilienertragsteuer A special form of income taxation for the sale of real estate. The standard rate on the corresponding income is 30%, but the tax base, exceptions, and special cases are calculated separately.
Neuvermögen Designation of properties for which actual tax revenues and expenses are typically calculated upon sale. It is more appropriate to assign a category based on the property's historical tax status, not solely on the date of purchase.
Altvermögen Designation of certain "old" properties for which a special income tax calculation is available upon sale. Applicability depends on the previous tax status and other circumstances, including the change in the land's intended use.
Hauptwohnsitzbefreiung Income from the sale of a primary residence is exempt from ImmoESt, subject to certain conditions. Registration as a Hauptwohnsitz is not sufficient; actual use and the required timeframes are essential.
Herstellerbefreiung An exemption related to the sale of a self-constructed building, subject to certain conditions being met. This exemption does not automatically apply to land or purchased and renovated properties.

What amounts cannot be combined?

Rent, rent, and heating may appear in the same monthly notice, but they are classified under different headings. For the investment model, it's necessary to determine which costs are borne by the landlord and which can be passed on to the tenant.

When assessing the purchase, additional payments and hidden costs when purchasing real estate in Austria, including legal services, applicable VAT and registration fees.

  • Case study:

The seller offered a €5,000 discount, but when reviewing the Hausverwaltung documents, I discovered upcoming façade repairs and an insufficient reserve. After comparing the project budget with the cost allocation key, I calculated the potential additional down payment for the apartment at €7,200. I then clarified the financing arrangements and payment terms. Before signing the contract, we agreed on the distribution of these expenses with the seller so that the buyer could estimate the full transaction budget.

6. Documents for the apartment and house

A single document doesn't provide a complete picture of a property. An extract shows registered rights, a plan shows the configuration, and management company documents show the building's financial status and upcoming work.

Term Meaning and what a buyer should check
Grundbuchauszug An extract from the land register. Sheet A contains information about the property and related records, Sheet B contains ownership information, and Sheet C contains encumbrances. The relevance and content of the supporting documents are important.
Exposé An informational description of the property. Its data must be verified, but it cannot be assumed that it never has legal significance: specific statements may affect the agreed-upon characteristics and responsibilities.
Energieausweis Energy Performance Certificate. When selling or renting a property, unless otherwise specified, a document no older than ten years must be presented. The estimates contained in this document are not equivalent to the actual heating bill.
Nutzwertgutachten Expert opinions on the Nutzwert of individual properties. Helps compare apartments, accessories, and shares in shared property.
Wohnungseigentumsvertrag Apartment ownership agreement. Regulates the relevant rights, the purpose of the property, and the relationships between owners. It is read in conjunction with the registration and other documents.
Hausordnung House rules, such as rules regarding the use of common areas and keeping quiet, do not automatically override legally granted rights.
Protokoll der Eigentümerversammlung Minutes of the owners' meeting. Contains discussions and decisions. For future expenses, it is important to establish what exactly was decided, in what order, and how it will be financed.
Jahresabrechnung An annual property management report. It covers income, expenses, balances, and the distribution of accruals.
Vorausschau Preliminary information from the management company on proposed work and expenses. Helps identify plans not yet reflected in current payments.
Baubewilligung A building permit or certain modifications are issued. They verify that the actual construction complies with the approved design.
Benützungsbewilligung Permission to use the completed structure where it is required. Depending on the land and procedure, another document, such as a notice of completion, may be relevant.
Bauträgervertrag Contract with the developer. If the terms are met, a special buyer protection regime under the BTVG applies. Not every contract with a developer automatically comes with the same guarantees.
Treuhandvertrag A trust agreement. It establishes who accepts the funds, what conditions they check, and when they are authorized to transfer the funds.
Finanzierungszusage Financing confirmation. This may be conditional, time-limited, or contingent on the property's valuation. It's important to check whether it represents the bank's final commitment.
Grundriss An apartment plan alone does not confirm the legality of the redevelopment or the accuracy of the area indicated; the origin, date, and correspondence to the actual condition are important.
Meldezettel Residence registration form. This form does not constitute a title deed or a permit to purchase real estate. The relevant registration information is used to confirm registration.

What to request in addition to the ad

A preliminary inspection typically requires a current extract, a plan, apartment ownership documents, and an energy performance certificate. For a building assessment, the most recent annual reports, information on the building's Rücklage (building code), Vorausschau (building code), and meeting minutes for several years are useful. This is a practical set of documents, not a mandatory list for every transaction.

If there's a remodel, attic, separate garden, or parking space, documents confirming their status are required. If the apartment is occupied by a tenant, a current contract and additional agreements are required.

7. Parties to the transaction and government agencies

Before purchasing, it's helpful to find out who selects the property, who prepares the contract, who inspects the technical condition, and who is responsible for the trust accounts. One specialist can perform several functions, but the scope of their work must be defined.

Term Meaning and what a buyer should check
Rechtsanwalt Attorney. Can provide transaction consultations, draft contracts, and assist with settlements and registration. The parties represented and the scope of the assignment must be clarified.
Notar Notary. Certifies signatures and documents, and can also prepare contracts and handle fiduciary transactions. Their role is not limited to certifying signatures.
Parteienvertreter A representative of a party or parties; in tax and registration contexts, often a lawyer or notary. The meaning depends on the specific procedure.
Treuhänder The person executing the fiduciary duty accepts and transfers funds according to the agreed terms. Protection is ensured by the terms and proper execution of the duty, not by a promise of literal simultaneity.
Immobilienmakler Real estate broker. May act as a second agent for both parties during a sale. Their informational duties do not replace independent legal representation for the buyer.
Immobilientreuhänder A regulated professional category that includes the following professions: Immobilienmakler, Immobilienverwalter, and Bauträger. The term itself does not guarantee that a specific person is qualified to perform all of these jobs.
Hausverwaltung Management company or manager. Organizes management of the building within the mandate and the law, maintains records, and interacts with the owners.
Bauträger The developer or organizer of the construction project. They check the legal entity, the project, permits, and contractual obligations.
Sachverständiger An expert in the relevant field. Can assess value, technical condition, or Nutzwert. Being a forensically certified expert requires separate confirmation.
Bezirksgericht District court. Depending on its jurisdiction, it hears certain housing cases and maintains the Grundbuch.
Grundbuchsgericht The court competent for matters of registration in the Grundbuch. This is a designation of a function, not a separate profession.
Magistrate The administration of a city with special status, including Vienna. Specific requests are sent to the competent department.
Magistratsabteilung (MA) A Vienna city administration department, designated by a number. The appropriate department is selected based on the subject of the request, not just the general term "real estate.".
Finanzamt Tax authority. Responsible for tax matters within its jurisdiction.
Mietervereinigung An organization that advises and represents tenants on specific issues. Terms of assistance and membership are specified separately.
Wirtschaftskammer (WKO) Austrian Economic Chamber. Provides professional information and company search services. The scope of permitted commercial activity is also verified using the Gewerbeberechtigung (Genuine and Legal Entity Certificate) and the GISA register.

Whose interests does the agent take into account?

In Austria, it's common for a real estate broker to act as a "Doppelmakler" (a "doubt broker"). In this case, the broker must consider the interests of both parties. This differs from instructing a lawyer to represent the interests of one party independently.

Therefore, it's important for the buyer to ask two questions: in what capacity does the intermediary act and who specifically verifies the legal terms of the transaction for the buyer. Similarly, it's important to clarify the functions of the notary, lawyer, and Treuhänder, if they are all combined.

Terms that are often misunderstood

Term Common understanding What does this mean in practice?
Neubau Just a newly built apartment The market category may include homes from previous decades. The year and condition are verified separately.
Erstbezug A new building is a must May indicate the first occupancy after reconstruction.
Nutzfläche The sum of the area of the apartment, balcony, terrace and basement The composition is determined by applicable regulations. Loggias and open balconies are counted differently.
Betriebskosten All monthly expenses of the owner Reserve, heating, electricity and repairs can be separate items.

Frequently asked questions

At what point does a buyer become the owner of an apartment in Austria?

For a standard purchase, this is after the title is registered in Grundbuch. Signing the contract, paying, and receiving the keys do not, in and of themselves, replace this registration.

Can Kaufanbot be considered a regular reservation?

No. This is an offer with potentially binding consequences. Before signing, you should check its contents, validity period, and the terms and conditions of the transaction.

Is the loggia included in the Nutzfläche?

If the established criteria are met, it is included. An open balcony or terrace, like a loggia, is not counted according to MRG and WEG rules. The plan and calculation basis are checked for the specific apartment.

Is it possible to determine the rental mode using the words Altbau or Neubau?

No. Construction documents, apartment ownership, financing, the building's history, and any exemptions are all relevant. The age of the façade or the wording of the listing are not sufficient.

Who draws up the purchase agreement: a lawyer or a notary?

The agreement can be prepared by a lawyer or a notary. Both can perform related functions, including fiduciary support. The specific division of responsibilities is determined during the transaction approval process.

Does the agent necessarily represent only the seller?

No. During a sale, they can act as a doppelganger and take into account the interests of both parties. This does not eliminate the need to understand the scope of their mandate and separately verify the legal terms of the purchase.

Does Vorsorgewohnung mean a guaranteed return?

No. Profitability depends on the price, permitted rent, operating expenses, downtime, repairs, financing, and taxes. The property title does not confirm either income or VAT deduction eligibility.

Does the company allow foreigners to buy real estate without permission?

Not automatically. The applicability of permitting rules depends on the land, the property, and the company's ownership structure. Tax implications and acquisition permits are separate matters.

Where can I get an extract from the Grundbuch?

Through official justice services, authorized services, a lawyer, or a notary. Access conditions and cost depend on the request method. Starting October 1, 2026, property owners can receive free electronic extracts for their property through JustizOnline, up to the required amount.

"A client who understands the terminology asks different questions. They don't ask, 'Is this a good area?' but, 'What's the MRG regime like here and what's in the meeting minutes for the last three years?' With such a client, the transaction goes faster and cheaper—simply because we don't waste time explaining the obvious and don't run into surprises at the final stage.".

During my time working in the Austrian market, I've noticed a pattern: buyers' mistakes are rarely due to a lack of market knowledge. They're almost always due to a familiar term being misinterpreted. They calculate the yield based on the area, which is actually measured differently. They plan their budget without ancillary expenses, because in their country they amount to fractions of a percent. They plan to raise rent, unaware that the building is fully covered by the MRG.

That's why the first document I send to a new client isn't a collection of objects, but a dictionary. From then on, the conversation flows in the same language.

A quick checklist before purchasing

This list helps you prepare documents and questions. The scope of the due diligence depends on the property and the terms of the transaction.

Object and rights

  • The current Grundbuch extract has been received; the owner, share and object have been compared with the offer.
  • The encumbrances have been examined, including the supporting documents.
  • It is clear which encumbrances remain and which are removed.
  • The status of the basement, parking space, garden or terrace is confirmed by documents.
  • The area and plan are compared with the actual condition and permitted changes.

Home and future expenses

  • Apartment ownership documents received.
  • The latest annual reports, information on Rücklage and Vorausschau were studied.
  • Available meeting minutes and decisions regarding work were reviewed.
  • Current payments by the owner and possible additional contributions are set separately.
  • The energy passport and available technical documents have been verified.

Use and rent

  • The object's intended purpose has been established.
  • If you plan to rent out the property, check the applicable rental regime.
  • For the occupied apartment, the lease agreement and additional agreements have been reviewed.
  • Use as a second or tourist home is checked separately if this is consistent with the purpose of purchase.

Transaction and settlements

  • Before signing the Kaufanbot, the necessary financing and permit conditions were agreed upon.
  • Permitting requirements are defined for the buyer and the chosen ownership structure.
  • Expenses in excess of the property price are calculated.
  • The functions of the participants and the scope of their assignments are known.
  • The terms of trust settlements, removal of encumbrances and registration are reflected in the documents.
  • The date of transfer, the condition of the apartment and the procedure for drawing up the protocol have been agreed upon.

What is worth remembering

The terminology in an Austrian transaction isn't a formality, but a way to understand the real parameters of a property. Three things are worth remembering, even if you don't have time to read the entire dictionary:

Ownership rights arise at the moment of entry in the Grundbuch, not upon signing the contract or payment. Everything that happens between these events is protected by a priority record and a trust account—their existence is verified before the money is transferred.

A share in a building, not an apartment, is being purchased. This includes the Nutzwert, common area expenses, owners' meeting decisions, and a repair reserve. Meeting minutes provide a more accurate picture of future expenses than any property description.

The rental property regime determines the yield. Before calculating the model, it's important to know whether the building is fully, partially, or foreclosed on. In 2026, new rules for indexation and contract term were added.
